Recent Stark Law Developments in the News


In a recent Stark Law case development, the Washington state court heard the case of a PT practice claiming that doctors are profiting illegally from referrals they make to physical therapists who work for them. The case, Columbia Physical Therapy v. Benton Franklin Orthopedic Associates is being closely watched by both physicians and physical therapists. If the suit is lost, many believe that it will be impossible for physicians to hire physical therapists inside an orthopedic clinic, as is now the case in the state of South Carolina.
This trend potentially represents more opportunities for PTs and a reduction in opportunities for orthopedists.

The case was heard in November 2009. A decision is expected shortly.
